The protection of your personal data is a priority for A2 CERAMICA UNIPESSOAL LDA., therefore, under Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Regulation on the Protection of Personal Data), we are pleased to communicate our Privacy Policy, which will inform you of the new rules applicable to the processing of your personal data, the rights that you have, as well as inform you of how you can manage, directly and simply, the respective consents.

The rules set out in this Privacy Policy complement the provisions on the protection and processing of personal data set out in the “General Conditions of the a2ceramica.pt store”, which regulate the offer of our products and are duly advertised on the website, and are accepted by the Customer.

This Privacy Policy applies exclusively to the collection and processing of personal data carried out by A2 CERAMICA UNIPESSOAL LDA.

Who are we?

Your data will be processed by A2 CERAMICA UNIPESSOAL LDA., a limited liability company with registered office at Rua do Crespo, nº19 Casal do Arqueiro – Batalha – 2440-019 Batalha, registered under individual corporate number 516581414, with share capital of €1,500.00 (one thousand and five hundred euros), (hereinafter referred to as A2 CERAMICA ).

A2 CERAMICA is responsible for the processing of your personal data, within the meaning of the General Data Protection Regulation (hereinafter referred to as GDPR).

What is personal data?

Personal data is any information, of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person.

An identifiable person is one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

What kind of personal data do we collect?

As part of its activity, A2 CERAMICA will collect and process the personal data necessary for the sales and delivery process of the goods purchased by the Customer, in particular the name, address, telephone number, email address, payment details, Internet Protocol (IP) address, tax identification number.

Why do we process your information?

Your personal data may be collected and processed by A2 CERAMICA for the following purposes:

a)     compliance with legal obligations to which A2 CERAMICA is subject, namely invoicing of purchased goods;

b)     compliance with A2 CERAMICA’s contractual obligations, in particular for the purposes of the logistical process of delivering the purchased goods;

c)      effects of managing contacts and complaints;

d)     contact purposes, within the scope of A2 CERAMICA’s marketing strategies, with commercial information and communications, namely through the sending of newsletters

Failure to provide personal data for the purposes set out in paragraphs a) and b) implies non-compliance by A2 CERAMICA with the contractual and legal obligations imposed on it, a situation which constitutes grounds for non-execution of the purchase and sale contract by A2 CERAMICA, without the right to any compensation or indemnity.

A2 CERAMICA will inform you of the mandatory nature of the data.

What do we process your information for?

The processing of your personal data will be carried out based on the execution of the product purchase and sale contract entered into with A2 CERAMICA, and in strict compliance with legal obligations imposed on A2 CERAMICA, namely in terms of tax legislation (cfr. paragraphs b) and c) of no. 1 of article 6 of the GDPR).

For the purpose set out in paragraph c) of the previous point, A2 CERAMICA will process personal data, based on the legitimate interest pursued by itself, as well as that of the Customer (cfr. paragraph f) of no. 1 of article 6 of the GDPR).

Furthermore, the lawfulness of the processing of personal data collected for the purpose set out in paragraph d) of the previous point is based on the consent given by the company to A2 CERAMICA for the respective processing (cf. paragraph a) of no. 1 of article 6 of the GDPR).

How long do we keep your information?

Without prejudice to legal provisions, regulations or judicial determinations to the contrary, the personal data collected will be kept only for the minimum period necessary for the purposes that motivated its collection or subsequent processing.

The most relevant retention periods that we define for the purposes of using your personal data are as follows:

i. Transaction management – ​​legal term of 10 years;

ii. Customer management in loyalty programs – 3 years

iii. Marketing – 2 years (plus current year) since last interaction;

iv. Management of users of websites or platforms – 1 year (plus current year) after the last access;

v. Home deliveries – 2 years;

vi. Warranties and after-sales support – 2 years or equal to the warranty period if longer;

vii. Registration and proof of transactions for remote contracts – 6 months after the contract term;

viii. Service management – ​​2 years since the last service.

To whom can we transmit your personal data?

Eventually, A2 CERAMICA may have to share some of your personal data with other recipients, which include:

a)     Organizations and/or companies affiliated with A2 CERAMICA, provided that they respect an equivalent policy regarding the protection of personal data;

b)     Public Entities to which A2 CERAMICA is legally obliged to provide information, namely the DGCI – General Tax Directorate;

c)      Subcontractors who provide certain services related to your personal data under the cover of a subcontract and for the sole purpose of providing technical assistance to A2 CERAMICA, which include, but are not limited to, website hosting providers, mail and marketing service providers;

d)     The competent authorities to which A2 CERAMICA is legally obliged to disclose information in the course of legal proceedings, or to detect technical and/or security problems, such as judicial entities or competent control authorities.

Is your data transferred to countries outside the European Union?

Your personal data, collected by A2 CERAMICA, will not, as a rule, be transferred to any entity established outside the territory of the European Union.

Exceptionally and under certain conditions, A2 CERAMICA may transfer your personal data to countries outside the European Union, in accordance with applicable legislation, for the purposes of data hosting or storage, technical subcontracting of processing, back-up and recovery of hosted data, development of services.

A2 CERAMICA ensures that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.

What are your rights?

Under the terms of the GDPR, you may request, at any time:

a)     access to your personal data: You have the right to obtain confirmation as to whether or not personal data concerning you are being processed and, where this is the case, the right to access your personal data and the information provided for in the GDPR.

b)     the rectification of your personal data: You have the right to obtain from A2 CERAMICA, without undue delay, the rectification of inaccurate personal data concerning you.

c)     the deletion of your personal data: You have the right to obtain from A2 CERAMICA, without undue delay, the erasure of your personal data, and A2 CERAMICA must erase your personal data, without undue delay, when, in particular, one of the following reasons applies: 1) the personal data are no longer necessary for the purpose for which they were collected or processed; 2) the holder of the personal data withdraws the consent on which the processing of the data is based (when it is based on consent) and if there is no other legal basis for said processing; 3) the data subject objects to the processing and there are no overriding legitimate interests justifying the processing;

d)     the limitation of the processing carried out: You have the right to obtain from A2 CERAMICA the restriction of processing, if one of the following situations applies: a) contest the accuracy of personal data, for a period that allows A2 CERAMICA to verify its accuracy; b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use; c) A2 CERAMICA no longer needs the personal data for processing purposes, but such data is required by the holder for the purposes of declaring, exercising or defending a right in a legal proceeding; d) if you have objected to the processing, until it is verified that the legitimate reasons of A2 CERAMICA prevail over those of the data subject.

e)     the right to object to processing: when processing is carried out for the purposes of the legitimate interests pursued by A2 CERAMICA, the data subject has the right to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her. A2 CERAMICA will cease processing personal data unless it demonstrates compelling legitimate grounds for such processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

f)      the right to data portability: under the terms and conditions defined by law, you have the right to receive the personal data concerning you and that you have provided to A2 CERAMICA, in a structured, commonly used and machine-readable format, and the right to transmit this data to another data controller without the controller to whom the personal data was provided being able to prevent it, if a) The processing is based on consent or a contract; and b) The processing is carried out by automated means.

If the requests submitted are manifestly unfounded or excessive, particularly due to their repetitive nature, A2 CERAMICA may (i) require payment of a reasonable fee taking into account the administrative costs of providing the information or communications, or of taking the requested action, or (ii) refuse to comply with your request.

In relation to personal data whose processing by A2 CERAMICA is legitimised by the consent granted by it, you are granted the right to withdraw consent, without the exercise of such right compromising the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of the same data, based on another legal basis, such as compliance with a contractual or legal obligation to which A2 CERAMICA is subject.

You also have the right to lodge a complaint with the National Data Protection Commission.

How can you object to being contacted for marketing purposes?

Within the scope of the consent provided by it, A2 CERAMICA may promote, in particular, actions to publicize new products or services by telephone, email, post, SMS, MMS, or any other electronic communications service.

If you do not want your personal data to be processed, you can object at any time to the use of your personal data for marketing purposes, sending of informative communications or inclusion in lists or information services.
