General Conditions of the Store www.a2ceramica.pt

Article 1.

(Scope and Definitions)

1.      These general conditions apply to all transactions carried out when purchasing products through the website with the address www.a2ceramica.pt, including registration and order.

2.      For the purpose of these general conditions, the following definitions apply:

a.      A2 CERAMICA”: A2 CERAMICA UNIPESSOAL, LDA., a limited liability company with registered office at Rua do Crespo, no. 19 Casal do Arqueiro – Batalha – 2440-019 Batalha, registered under individual corporate number 517696088, holder of all copyright and related rights over the website with the address www.a2ceramica.pt, as well as other rights that may be subject to protection provided for in the Industrial Property Code;

b.      Customer”: any entity, which makes an order through the website with the address www.a2ceramica.pt

3.      These general conditions do not exclude the Customer's rights and guarantees contained in current legislation for contracts of this nature.

4.      A2 CERAMICA UNIPESSOAL, LDA. reserves the right to change these “General Conditions of Sale”, without prior notice, making the necessary changes to the website and ensuring that these changes will not affect purchases that have already been made prior to their implementation.

Article 2.

(Registration)

1.      To place an order, the Customer must be registered, and can do so via the website at the address www.a2ceramica.pt, by filling in the fields on the form provided there.

2.      After registering as a Customer, you will be able to access your personal online account by logging in using the personal and non-transferable password chosen by you at the time of registration.

3.      From the moment you log in to the website www.a2ceramica.pt, the Customer is subject to these general conditions, as well as the legal and regulatory standards that govern their operation and use.

Article 3.

(Order)

1.      To place an order, the Customer must access his/her personal online account on the website www.a2ceramica.pt, by logging in using your email and password, and selecting the product or products available for sale online, completing the order by confirming the delivery address, tax identification number and final validation of the order.

2.      After final validation of the order, the Customer will receive an automatic “Order Confirmation” email message, which will be analyzed by the internal services of A2 CERAMICA UNIPESSOAL, LDA., in order to assess the delivery conditions of the product or products ordered. This phase is intended to be as short as possible, preferably being completed on the same day.

3.      An email will be sent indicating the availability of the material and including a Delivery Note, which will detail the information required for effective payment, namely Multibanco Reference or IBAN for Bank Transfer. Possibly, at this stage, if there is a need for clarification, there may be telephone contact.

4.      After identification of effective receipt, an email message will be sent, indicating the link that will allow you to track the delivery of the order through the website. www.a2ceramica.pt.

3.      Order tracking can also be done via the “My Account” link, found in the Customer’s personal account on the website. www.a2ceramica.pt.

4.      The final validation of the order constitutes, on the part of the Customer, a declaration of full and unconditional acceptance of the business concluded, including the acceptance of these General Conditions of Sale, of the legal and regulatory standards that govern purchases of this nature, of the price and characteristics of the product ordered, with the consequent mutual enforceability (by the Customer and A2 CERAMICA UNIPESSOAL, LDA.) of the services contained in the order communication document.

5.      Products available for order can be found on the website www.a2ceramica.pt.

Article 4.

(Price and features of products)

1.      The prices of products for sale on the website www.a2ceramica.pt are priced in Euros (€) and include VAT at the legal rate in force, unless otherwise indicated.

2.      The prices indicated does not include shipping costs, called shipping costs, which will be added to the total order value, after selecting the shipping type from the available options.

3.      The prices of the products listed on the website www.a2ceramica.pt may be modified at any time, without prior notice, but not after acceptance of the Customer's order by A2 CERAMICA UNIPESSOAL, LDA.

4.      The products made available by A2 CERAMICA UNIPESSOAL, LDA. are presented on the website www.a2ceramica.pt, accompanied by a description of their characteristics, meaning that the Customer is aware of them before placing the order.

5.      With the confirmation of the order, the purchase and sale contract for the products is formalized, as well as the inherent delivery service.

6.      After the order is confirmed, an email will be sent to the customer with a summary of the order.

7.      The order will be delivered to the address indicated by the customer who makes the payment by Multibanco or MBWay, or another method made available, prior to receiving the order.

8.      For items sold by weight, this will be approximate and may be subject to changes and variations.

9.      The use of the website www.a2ceramica.ptdoes not imply any additional costs.

10.   The minimum shipping costs through the logistics operator A2 CERAMICA UNIPESSOAL, LDA. for mainland Portugal is €10.

11.   Notwithstanding the provisions of the previous paragraphs, the amounts mentioned are subject to change without prior notice, and the Customer may check the amount of shipping costs to be charged at the time of completing the order.

12.   A2 CERAMICA UNIPESSOAL, LDA. may make available on the website www.a2ceramica.pt other delivery services, with prices varying according to the method chosen by the Customer.

13.   For more information regarding shipping costs, the Customer may contact A2 CERAMICA UNIPESSOAL, LDA. via the email address madalena.almadeartista@gmail.com.

14.   A2 CERAMICA UNIPESSOAL, LDA. reserves the right to ship the products ordered free of charge (“free shipping”), this possibility being expressly indicated on the website. www.a2ceramica.pt and, if applicable, will be referred to at the time of completion of the order.

Article 5.

(Delivery)

1.      A2 CERAMICA UNIPESSOAL, LDA. will ship the product(s) ordered by the Customer through the logistics operator, to the address indicated by the Customer at the time of order confirmation, which may be different from the address indicated for billing.

2.      Deliveries will be made on the days and times used by the logistics operator.

3.      A2 CERAMICA UNIPESSOAL, LDA. will not deliver any product to PO boxes.

4.       A2 CERAMICA UNIPESSOAL, LDA. undertakes to send the order within a maximum period of 15 (fifteen) working days.

5.      In the event of product unavailability, particularly due to stock shortages, A2 CERAMICA UNIPESSOAL, LDA. will inform the Customer and may replace the product upon acceptance by the Customer, with the Customer not being entitled to any compensation for this situation.

6.      The transport time, which will depend on the logistics operator and the destination of the order, is added to the deadlines stipulated in the previous numbers.

7.      Upon delivery of the order, the logistics operator collects the signature of the person receiving it at the address indicated by the Customer, after the latter has carefully inspected it. Refusal to sign the delivery document implies the recording of this fact in said document and the non-delivery of the order to the Customer.

8.      If the order is damaged, the Customer must refuse delivery or accept it with reservations, stating these on the delivery document.

9.      For the purposes of the previous paragraph, the Customer must also contact A2 CERAMICA UNIPESSOAL, LDA., through the address madalena.almadeartista@gmail.com

10.   If it is not possible to deliver the order, the logistics operator will leave a notice in the Customer's mailbox, and the Customer must contact the operator directly in order to schedule a new delivery during business hours, within a maximum period of 1 (one) business day.

11.   If the order cannot be successfully delivered on the new date, due to a reason attributable to the Customer, the order will be returned to A2 CERAMICA UNIPESSOAL, LDA.

12.   If the Customer does not receive the order under the terms set out in the previous numbers, and it is returned, the purchase will be deemed cancelled.

13.   A2 CERAMICA UNIPESSOAL, LDA. cannot be held responsible for delays in the delivery of products ordered when this results from a force majeure event or fortuitous event, namely strikes, pandemics, acts of war or terrorism, riots, blockades, insurrections, acts of sabotage, earthquakes, tornadoes, hurricanes, storms, fires, floods or other extreme weather or environmental conditions, as well as for any act of public authority, provided that it is not attributable to A2 CERAMICA UNIPESSOAL, LDA.

14.   In the event of any force majeure or fortuitous event, the delivery period for the products ordered will be extended until the time when fulfillment of the obligation is possible.

15.   If 4 (four) months have passed without the force majeure event having ceased, either Party shall have the right to terminate the contract on such grounds.

Article 6.

(Return Policy)

1. A2 CERAMICA UNIPESSOAL, LDA. will accept returns, when legally required.

2. The Customer in our online store has the right, without incurring any costs, to terminate the contract within a maximum period of 30 days. consecutive days, counting from the day on which you take effective possession of the property, and for this purpose, without needing to invoke a reason, you must communicate to A2 CERAMICA UNIPESSOAL, LDA. by means of any unequivocal statement, your intention to terminate the contract.

3. The CLIENT cannot freely terminate contracts for:

a)    Supply of goods made according to consumer specifications or clearly personalized;

b)    Supply of goods which, by their nature, cannot be returned or are likely to deteriorate or expire quickly;

c)    Supply of sealed goods which are not returnable for reasons of health protection or hygiene when opened after delivery;

d)    Supply of goods which, after delivery and by their nature, are inseparably mixed with other articles;

e)    Supply of newspaper, periodical or magazine, with the exception of subscription contracts for sending these publications;

4. To return the product, it must be in perfect condition, in its original packaging, not damaged, altered or scratched, and with all accessories or promotional offers, if included, and also duly accompanied by proof of purchase or invoice.

5. After receiving the product and verifying its perfect condition, A2 CERAMICA UNIPESSOAL, LDA. will accept the return of the product, proceeding with the respective refund within 30 days.

6. In the event of a stock shortage, A2 CERAMICA UNIPESSOAL, LDA. will refund the amount paid by the Customer, using the same payment method used by the Customer in the initial transaction.

7. The refund provided for in the caput will be made in accordance with the price actually paid for the product, excluding shipping costs.

8.  Except as provided in the following paragraph, all expenses arising from the return of the order will be borne by the Customer.

9. In any case, the return of defective products and/or incorrect shipments will be permitted, with A2 CERAMICA UNIPESSOAL LTDA. being responsible for the shipping and return costs of the same whenever the Customer communicates this circumstance to the abovementioned address, within 1 (one) day from the date of receipt of the products.

10. In the situation provided for in the previous paragraph, A2 CERAMICA UNIPESSOAL, LDA. assumes responsibility for any original defects presented by the product ordered, and will exchange the product or refund the amount paid, without any costs to the Customer.

11. A2 CERAMICA UNIPESSOAL, LDA. will not accept the return of damaged products, or those that show clear signs of use, and will not be responsible for deficiencies resulting from incorrect and/or negligent use, nor for components subject to wear and tear due to normal use of the product.

12. The Customer may submit complaints or requests for resolution via the electronic address madalena.almadeartista@gmail.com, or in writing, to the address Rua do Crespo, 19 – Casal do Arqueiro – 2440-019 Batalha.

Article 7.

(Responsibility)

1.      A2 CERAMICA UNIPESSOAL, LDA. is not responsible for any damage resulting from abusive intervention by third parties in the computer system that supports the website, nor for damage resulting from the use of the internet and resulting from the presence of computer viruses or other malicious software.

2.      The website www.a2ceramica.pt has the exclusive objectives of marketing and selling decorative ceramic articles for utilitarian and decorative use, pottery, manufacturing and painting of tiles, earthenware and stoneware to the Customer, under the conditions indicated, as well as providing a personal account to order these products, and the website may not be used for any other purpose.

3.      A2 CERAMICA UNIPESSOAL, LDA. will not be responsible for any abusive use by third parties of the website access data, which are personal and non-transferable.

Article 8.

(Duration)

1.      These General Conditions of Sale apply for the duration of the commercial relationship established between the Customer and A2 CERAMICA UNIPESSOAL, LDA., concluded through the website www.a2ceramica.pt.

2.      The provisions of the previous paragraph do not affect the possibility of subsequent review or modification of these conditions by A2 CERAMICA UNIPESSOAL, LDA.

Article 9.

(Evidence and Archive)

1.      The computer records kept in the computer system of A2 CERAMICA UNIPESSOAL, LDA. are considered evidence of the conclusion of the contract between the Parties, as well as the conditions under which it was concluded.

2.      The archiving of documents proving orders and associated invoices will be carried out in a reliable and durable medium.

Article 10.

(Applicable law and jurisdiction)

1.      These General Conditions of Sale are governed, in all matters that are omitted, by Portuguese law.

2.      In the event of a dispute regarding the validity, interpretation or application of these general conditions, the Parties shall endeavor, by all possible means of dialogue and means of composing interests, to obtain a concerted solution to the matter.

3.      If the dispute persists, the consumer may resort to a Consumer Dispute Resolution Entity:
